I am in the same boat. My 7-9 yr extn will be up in December. My PD is Dec 2005 EB2. I would like to apply for 3 yr extn of H1. I am thinking if I should just renew my EAD instead of renewing my H1. Also what would be the filing fee for H1? $320 or $320 + $1500?
Thanks.
My Green card is in the processing and I-140 was approved
in Dec 2007. The priority date is in Jun 2007 and EB2 category. Applied for renewal of EAD and AP recently.
I am on H1b and it is due for renewal in 3 months. I will be on H1b for 4 1/2 yrs by that time.
I hope h1b will be issued for 3 yrs since pending 485 for more than a year.
I think renewing is helpful just in case if there is any issue with 485.
1. Is it worth to renew H1b?
2. How much will it cost to renew H1b?
3. Since the h1b is issued for 3 yrs based on pending 485. If any issue with 485 will it impact H1b?
Thanks in advance.

I recieved a letter from USCIS saying "we have forwarded your inquiry to Sec 245 Unit. You will be notified by mail at later date".
What exactly this means?
Do I need to worry about this Sec 245 Unit. Is it good or bad?
btw I am on EB2 priority date Aug 2005 and still waiting for GC.......

Pappu, very good article. I saw this in this month's Kiplinger.
A penny saved is 'far better than' a penny earned because you don't have to pay taxes for the penny you saved whereas you have to pay taxes for the one you earned!
these things are like taking a duck to the pond ... for a Desi..

An interesting survey showing 51% of voters in one of America's most politically conservative states favor legalizing illegally present immigrants in one form or another:Tennesseans appear ambivalent about how best to deal with illegal immigrants currently working in the United States. The largest proportion (43 percent) says such illegal immigrants should be required to leave their jobs and leave the country. But the next largest proportion (29 percent) takes the opposite view, saying such individuals should be allowed to stay in their jobs and eventually apply for U.S. citizenship. Finally, another 22 percent say such individuals should be allowed to...

LA OPINION (Editorial): The time is now!

The time is now! - La Opinin - noticias locales, nacionales e internacionales desde Los ngeles - impre.com (http://www.impre.com/laopinion/opinion/2010/11/16/the-time-is-now-222571-1.html#commentsBlock)
Democrats return back to a lame-duck Congressional session in which they have a majority in both chambers. This is the moment to make the effort to pass the DREAM Act and open up the path for hundreds of thousands of young people to enter the university or serve in the Armed Forces.
Major legislation on the agenda between now and the end of the year includes making permanent the Bush-era tax cuts, passing the fiscal year 2011 spending bill or at least passing a stopgap measure to continue to fund the government, extending unemployment benefits, and addressing cuts in Medicare payments to doctors.
There are many important issues on the floor and the position that will be taken by the Republicans is still unclear given they will have control of the House of Representatives in two months.
Despite this, we believe the DREAM Act must be added to the mix. In these past two years of Democratic control, the concerted push for comprehensive immigration reform never materialized. At a minimum, during these last weeks of legislative control, they should seek passage of legislation that would allow undocumented high school graduates who have grown up in the U.S. to continue their studies or to join the military.
Similar efforts a few months back failed because critics unjustly denounced the bill as an "amnesty," as if these young people were responsible for having been brought to the U.S. by their parents. Other critics charged that the bill would prove to be a magnet for immigrant parents to bring young children here. Such criticism ignores the real reasons for immigration.
This legislative session is filled with dozens of legislators who have either lost their reelection or are planning to retire. They have nothing to lose by doing the right thing and voting for a bill that will help the economy in the short and long term by preparing our countrys future labor force. And, at the same time, they will be strengthening the military.
Political savvy and determination will be needed to pass this legislation. Opportunities exist to attach it to other bills if it appears that it cannot be approved on its own. With so much at stake , the time to act is now!

Hi All,
Me and my wife are on EAD. We want to open LLC. Right now I am doing consulting in IT firm. My wife is not working anywhere. What are TAX and immigration consequences if we open LLC on my wife's name?
Questions we have..
1. Can I become parnter easily once my status got changed from EAD to GC?
2. Once my wife start LLC, can she work for another company e.g. Software consulting?
3. What would be tax bracket for my owner of LLC?
Thanks,
dj

Applied for 485/Ap/EAD on July 18th. Pending I140 was approved on Sep 14th. Checked online status the same day and LUD was 9/14.
After reading your post today, I checked the online status again and the LUD is 9/17.

My limited understanding about the GC process is that from the day I-485 is filed, a person may change his/her job only after 180 days or more, and of course by filing AC 21. Also, in case the I-485 does not get approved within the 180 days after filing, then how can a person change a job without having an EAD.
A person can EAD only once I-485 is approved? Is that correct. Please throw some light on the above points. Thanks in advance.
There is nothing like filing AC21, you may or may not inform uscis about changing job/new employer
Once your I-485 is approved you DONOT need EAD. Infact with approval of I-485-- EAD becomes defunt/invalid. You will need EAD based upon pending I-485 to switch jobs...

My I-485 is pending, was filed in July, 07. My PD is June, 04 (EB2 India). I-140 is approved. I have to leave the US for a year to work on an expat assignment beginning last week of December, 07. I have my EAD and AP. Also, I am on a valid H1-B until May, 2008 but will be applying for an extension until May, 2009.
Please let me know your thoughts if it would be ok for me to leave the US for a continuous period of one year while my I-485 is pending? I plan to renter the US on H-1B and not EAD/AP.
Also, does one need to be physically present in the US to renew EAD and AP? My EAD and AP will expire in September, 07 but will I be able to renew them when I am back in Jan,09?
For the period I am gone, do I need to pay any taxes on my foreign-earned income if I am going to a jurisdiction with which India has a favorable tax treaty? If my I-485 is pending but I am not working in the US, I do not need to pay taxes for the income earned abroad if I do not meet the "substantial prsence test" (183 days)?
Any thoughts will be much appreciated.
Thanks.

Anyone out there knows the answer?
I am currently working for Company A which sponsors my H1B. I wonder if I can work for another company on a part time basis. What's the requirement for concurrent H1B filing? And does concurrent H1B filing requires a new H1B application against the quota? Please provide guidance.
YOu can get second H1 for part-time. Ensure that the hours are correctly represented. New h1B will not be against quota. Review the I-129 application form. You will realize under what circumstances will you come under quota.
